Eminem Settles Civil Suit

MOUNT CLEMENS, Mich. (AP) A man has settled a civil lawsuit he filed against Eminem after the hip-hop superstar allegedly pulled a gun on him.

John Guerra will receive $100,000 minus attorneys' fees in the agreement he reached recently with the rapper, whose real name is Marshall Mathers III, The Macomb Daily reported Tuesday.

Guerra, 28, sued Eminem a few days after they confronted each other outside a Warren bar in June 2000. Guerra had kissed Eminem's then-wife, Kim Mathers, in public before the Grammy-winning musician allegedly pulled out an unloaded handgun and hit him in the head and face, according to the lawsuit.

Eminem pleaded guilty to charges of carrying a concealed weapon, and is serving two years' probation on the criminal charge.

Neither Eminem, 29, of Macomb County's Clinton Township, nor Guerra, of Warren, admitted liability or wrongdoing.

John Gaber, one of Guerra's attorneys, said the amount of the settlement was ``less than we wanted, but more than they had been hoping to pay.''

Geoffrey Fieger, who seems to hold a monopoly over Michigan's high-profile court cases, is taking over a civil suit against rapper Eminem.

The Southfield attorney confirmed his new case Thursday just before holding a news conference to announce a $750-million suit against Kroger Stores Inc. and William Davis & Associates Security Services Inc. in last week's death of a shoplifter.

"I'm surprised because of the notoriety that Geoffrey didn't come in earlier," said Eminem's civil lawyer, Peter Peacock. "He's a good lawyer, and it makes no difference to me in my preparation of the case."

Warren resident John Guerra sued Eminem for unspecified damages after a June 4 incident in front of a Warren nightclub. Guerra claims the rap star pistol-whipped him after seeing him kiss Eminem's wife, Kim Mathers, in the parking lot of Hot Rocks Cafe.

Fieger said Guerra and his original attorney, John J. Gaber, approached him for assistance early in the litigation and is now officially signing on. Gaber will continue to assist in the case, but Fieger said he and associate Robert Giroux will take over as lead attorneys.

"Considering the kind of influence and the money Eminem has at his disposal, we felt we needed a top-notch trial attorney," Gaber said Thursday.

The civil suit is Guerra's only chance for a day in court because Macomb County prosecutors dropped an assault with a deadly weapon charge against Eminem as part of a plea bargain Wednesday. Eminem, whose real name is Marshall Bruce Mathers III, pleaded guilty to a felony charge of carrying a concealed weapon and will be sentenced April 10.

Fieger said the plea makes no difference in his efforts.

"Maybe he'll only have to pay six months of life in jail, but he's going to have to pay money because you cannot do this and expect to walk away with impunity," he said. "I would suggest the best thing he can do is enter into a plea bargain with me."

Fieger, who has signed a deal with ABC television to star in a reality-based legal show, scoffed at the suggestion that the Eminem case could be fodder for his new endeavor.

"I don't take cases based upon my show," he said. "I have too many cases to think about that."
